Self-Hauling is regulated by the RWMA Mandatory Organic Waste Disposal Reduction Ordinance, City and County municipal codes and the collection service agreements between each City and County in the Yuba-Sutter region and Recology Yuba-Sutter. 

RWMA Mandatory Organic Waste Disposal Reduction Ordinance

The RWMA Mandatory Organic Waste Disposal Reduction Ordinance regulates self-hauling, except for self-hauling activities transporting organic waste to a Community Composting site; lawfully transporting construction and demolition debris from projects covered by the CALGeen Building Standards Code as determined by the respective City or County; or, for self-haul activity from within Low-Population Census Tract Areas With Approved Waivers. The Ordinance requires that self-haulers source separate all materials generated on-site that would be collected separately in the respective City or County’s recyclable materials, organics and solid waste collection program and to haul organic waste materials to a facility, operation, activity, or property that processes or recovers these materials. The Ordinance includes specific record keeping requirements for self-haulers that are businesses, organizations, agencies and multi-family residential properties.

Collection Service Agreements

The collection service agreements between each City and County and Recology Yuba-Sutter includes the following exceptions to the exclusive franchise agreement to collect recyclable materials, organic materials, construction and demolition debris and other solid waste in each of the cities and counties in the  Yuba-Sutter region: 

• Recyclable Materials, Organic Materials or Bulky Items. Recyclable materials, organic materials or bulky items that are source separated from solid waste and the generator sells or is otherwise compensated by a collector in a manner resulting in a net payment to the waste generator.
• Self-Hauled Materials. Solid waste, recyclable materials, bulky items, organic materials or construction and demolition debris which is removed from a premises and transported personally by the owner or occupant of such premises (or by their full-time employees) to a recycling, processing or disposal facility.
• Donated Source Separated Materials. Recyclable materials, organic materials or bulky items which are source separated at any premises by the waste generator and donated to youth, civic or charitable organizations.
• Beverage Containers. Containers delivered for recycling under the California Beverage Container Recycling and Litter Reduction Act, Section 14500, et seq. California Public Resources Code.
• Materials Removed by Customer’s Contractor as Incidental Part of Services. Solid waste, recyclable materials, organic materials, bulky items and/or construction and demolition debris removed from a premise by a company (e.g., gardener, landscaper, tree-trimming service, construction contractor, residential clean-out service) as an incidental part of the service being performed by the company where the company uses its own Fixed Body Vehicle and employees, and no Drop Box Containers are used for the collection and transportation of such materials.
